Anti–whaling activists are hailing the decision by a U.S. appeals court against whale hunting by the Makah tribe of northwest Washington state.

Antiwhaling activists are hailing the decision by a U.S. appeals court against whale hunting by the Makah tribe of northwest Washington state.

A 9th Circuit Court of Appeals panel in San Francisco agreed with whaling opponents who argued the government needed to study the impact of these hunts more thoroughly.

West Coast AntiWhaling Society spokesperson Anna Hall calls Friday's decision a reprieve for grey whales along the Washington state coast.

"This ruling basically gives us probably a couple of years worth of time, I hope, where perhaps we can answer some of these questions and really get a better understanding of what the impact of this hunt might be to the resident grey whales."

The Makah's whaling rights are guaranteed by a 1855 treaty.

The tribe resumed whaling after grey whales were removed from the Endangered Species List in 1994. Since then, tribal whalers have killed just one whale, in 1999.

Earlier this year, the International Whaling Commission authorized the tribe to continue whaling, allowing a harvest of up to four grey whales annually for five years.
