Alberta's highest court is upholding the murder acquittalsof a Calgary woman who left three newborns in a garbage dumpster.

Meredith Boroweic was convicted of two counts of infanticide and one count of aggravated assault in separate trials in 2013 and 2014.

Boroweic gave birth in 2008 and 2009. She admitted after each birth she disposed of the infants in a dumpster. The bodies of those newborns have never been found.

A third child born in 2010 survived when the baby's father unknowingly helped pull the infant out of neighbourhood trash bin.

The crown appealed Court of Queen's Bench Justice Peter McIntyre's decision in 2013 that Borowiec's mind was disturbed after giving birth, making murder convictions unwarranted.

In a written decision released Wednesday, the Alberta Court of Appeal said the lower court judge did not err in convicting Boroweic of infanticide instead of murder.
