Slain man was in jail over $110 fine

The inmate who was slain Thursday at the Edmonton Remand Centre was set to be released that day afterserving time for failing to haveproof of payment on the LRT.

Barry Raymond Stewart, 59, was found dead in a cell around 5 a.m. Thursday morning.

Another inmate, Justin Caldwell Somers, 25, is charged with second-degree murder in his death.

According to court documents, Stewart opted to go to jail instead of paying the $110 fine for the LRT infraction. He was also picked up on outstanding warrants and was sentenced to two days in jail.

He entered the remand centre on Tuesday and was set to be released Thursday, the day he was slain.

Somers was also brought to the remand centre Tuesday for allegedly failing to follow his bail conditions.

Sources tell CBC News that psychologists assessed Somers and recommended he be kept apart from other inmates.Instead, he was placed withStewart in a cell with mattresses on the floor and a bench attached to the wall.

Stewart was sleeping on the floor when the accused allegedly jumped off the bench onto Stewart's head. He thenallegedly stomped on him repeatedly while he was sleeping, sources said.

Correctional peace officers came running after they heard a noise. Sources say officers who came upon the incident were very shaken up by what they saw.
