Slaying victim feared for his life; protection order allegedly breached

Joel Labossiere, who was shot to death with his wife, Magdalena, in their south Winnipeg home on the weekend, had sought a protection order against an uncle before his death and the man is facing charges for breaching the court order.

Joel and Magdalena Labossiere were supposed to appear in court Tuesday morning to fight over a protection order granted in December against his uncle, Jerome Labossiere.

The family had been embroiled in a legal battle over the $1.3-million estate of Fernand and Rita Labossiere the parents of Jerome and grandparents of Joel who were found, along with their other son, Remi, shot to death in their farmhouse in St. Leon, Man., in November 2005.

No one has been charged in the St. Leon deaths, and police have not identified any suspects in the deaths of Joel and Magdalena.

In court documents obtained by CBC News, Joel Labossiere makes chilling allegations about his uncle, saying he fears for his safety. None of the allegations has been proven in court.

According to the documents, Joel alleged that Jerome threatened his life in the days after the deaths of Fernand, Rita and Remi.

Afteran undercover police operation put Jerome Labossiere behind bars for drug trafficking, Joel alleges his uncle called him from prison, saying he would "take care of business" once he was out.

Joel made submissions before the National Parole Board opposing his uncle's release from prison.

The protection order was granted in December, days after Jerome was released on day parole.

Jerome Labossiere has denied all allegations by this nephew, and was fighting the protection order in court, arguing that he had never demonstrated violent tendencies and had never been charged with any violent crimes.

CBC News has learned Jerome Labossiere was charged in January with breaching the protection order.His first court hearing concerning the alleged breach wasscheduled for June 26.
