Appearance to set bail hearing dates set for Brandon Phillips

A bail hearing will be set at Newfoundland and Labrador Supreme Court in St. John's for a man accused of killing Larry Wellman at a hotel in early October.

A bail hearing will be set at Newfoundland and Labrador Supreme Court in St. John's for a man accused of killing Larry Wellman at a hotel in early October.

Phillips, 27, is facing a number of charges, the most serious of which is first-degree murder, stemming from an armed robbery at the Captain's Quarters Hotel in St. John's Oct. 3.

Phillips, whoaccording to his defence team is a good candidate for bail, will head for a hearing on Nov. 25, at which time a date for a bail hearing will be set.

During a court appearance at provincial court Monday morning, defence lawyer Jeff Brace indicated that he and Mark Gruchy are still awaiting further disclosure in the case.

No-contact order

Mark Heerema and Shauna Macdonald, lawyers with Nova Scotia Public Prosecutions Service, have been brought in on the caseto avoid what the justice department in Newfoundland and Labradorcalls a potential conflict of interest.

In the meantime, an application has been made to allow Phillips to have contact with his mother, Deborah Phillips.

The prosecutors on the case have "indicated their willingness to consent" to allow ano-contact order to be lifted, according to the application filed by Brace.

She is on a no-contact list, along with Phillips'sgirlfriendJade Ball, Captain's Quarters owner Marcel Etheridge, the employee working the night of the killing,and members of Wellman's family.

Wellman, 63, died en route to hospital after being shot whileintervening an armed robbery.
