Doctor found guilty of violating patient-physician boundaries

A disciplinary panel has found a doctor from Pugwash, N.S. guilty of professional misconduct after he performed an inappropriate exam on a woman three years ago, but the details of the infraction won't be revealed for a few more weeks.

A female patient accused Dr. Oluwarotimi Fashoranti of fondling her breasts during a visit she made to the All Saints Hospital in Springhill in 2010.

The five-member panel from the College of Physicians and Surgeons ruled the doctor performed an inappropriate exam, but it dismissed a second charge that he had an inappropriate interaction with the woman.

A written decision will explain the split ruling, but the panel said it wont be ready for weeks.

Neither the doctor nor the patient would comment after the decision was reached, but they told different stories in their testimonies about what happened on July 29, 2010.

The woman, whose name is protected by a publication ban, said she simply wanted test results for her chronic pain, but the doctor examined her instead.

Both agreed an examination of her abdomen went by the book.

The woman claims Fashoranti pushed up her t-shirt and fondled her breasts during a second examination.

The doctor said he never performed a second exam.

Fashoranti faces sanctions now that he's been found guilty by the regulatory body for doctors of violating patient-physician boundaries.

The penalty will be revealed in the written decision.

In a criminal trial, a jury found the doctor not guilty of sexual assault.
