A Cape Breton businessman's second molestation trial started Monday in Port Hawkesbury, N.S.

Ernest Fenwick MacIntosh, 67, is charged with gross indecency and indecent assault over allegedincidents involving boys in the 1970s.

The court has banned the publication of any of the complainants' names.

The first man, called BM, began testifying in the morning. He told the court MacIntosh abused him on two occasions.

He said thefirst time was when he was 15 and theytook a trip to the annualCome Home Week celebration in Guysborough. BM said the second incident occurred at a Bedford motel during a trip to Halifax.

He testified that onboth occasions he awoke to find MacIntosh stroking his penis and then performing oral sex.

David Bright, MacIntosh's lawyer, questioned the accuracy of the dates the alleged offences occurred.

Bright also asked if the man had discussed his testimony with a witness from MacIntosh's first trial.

Bright will continued his cross-examination Monday afternoon.

MacIntosh appealing convictions

MacIntosh was convicted in July of 13 counts of indecent assault and gross indecency in two separate complaints dating to the 1970s. He was sentenced to four years in prison but was given credit for his two years in remand, leaving him only two years less a day to serve.

He is appealing those convictions.

Hewas granted bail in October and has been serving house arrest at his apartment in Dartmouth.

RCMP first received the complaints more than 15 years ago. MacIntosh was arrested in April 2007 near New Delhi, India, where he worked as a telecommunications specialist for 13 years.

He was extradited to Canada two months later.
