Murder trial hears witness testimony about chase from Algoma Tavern

Witnesses who saw Tim Lamothe's last moments testified today at a second degree murder trial in Sudbury.

Skylar Dalyk, 25, is on trial for the fatal stabbing.

Witness Roger Aubin was playing a game of road hockey on Dec.12, 2013 when he saw two men running away from the Algoma Tavern.

He told the court they ran within a couple of feet of him and disappeared around the corner of a house.

The man in front was carrying a shiny knife, Aubin said. The one behind was catching up and yelled to Aubin and his friends to stop the first man and he'd give them $50 each.

They rounded a corner and Aubin said he called 911 because he thought someone was being mugged.

Moments later, Aubin said the second man re-appeared and was slouched over and moaning. He walked away from Aubin, fell, then got up and stumbled a few more steps before falling and staying down.

Aubin testified that he asked if the hurt man needed help, to which the man said "yes," in a "gurgling" kind of way.

Under cross examination, Aubin told the court the man carrying the knife didn't attempt to hide it.

He told police in his statement that he thought this was a case of someone defending himself.

Dalyk's voice sounded 'scared'

Jurors have heard Lamothe went to the tavern to rough up Skylar Dalyk over an unpaid debt.

Witnesses in an apartment above the tavern have testified they heard yelling outside and then saw two strangers.

One witness told the court he heard Lamothe scream "Skylar, stop running."

The other, said the accused, Dalyk, cried "No, stop it."

During cross examination, witness Mathieu Larue described Lamothe's voice as aggressive and intimidating, and said Dalyk's voice sounded scared, as if he was in pain.

Neither of the witnesses saw any weapons.
