Skylar Dalyk sentence: 5.5 years for killing Timothy Lamothe

A Sudbury man will spend another 2.5 years in jail for stabbing a man to death on the streets of Chelmsford two years ago.

Skylar Dalyk, 26, was convicted of manslaughter late last year for the killing of Timothy Lamothe.

In December 2013, Dalyk showed up to the Algoma Tavern in Chelmsford, planning to make a drug deal and was ambushed by a man he owed money to.

Timothy Lamothe chased him through the streets, until Dalyk pulled out a knife and stabbed him.

In her ruling today, Justice Louise Gauthier said Dalyk had "good reason to be afraid of Lamothe,"who had sent him "extremely threatening" messages in the days before he was killed.

She found that Dalyk "did not mean to kill" Lamothe that night and had a "lack of intent."

Community impact

Gauthier also addressed the Lamothe family, saying that Timothy was a "young manwho, despite some bad choices, had a whole future ahead of him."

She also noted that there was an impact to the community of Chelmsford, noting that Dalyk and Lamothe ran past some boys playing road hockey, showing how safe people believed their neighbourhood to be.

Gauthier sentenced Dalyk to 5.5years in prison, an amount that landed between the nine years sought by the Crown and the three or four years suggested by the defence.

Dalyk hasalready served closed to two years, but will get credit for three, thanks to what the judge described as "extremely harsh" conditions in the Sudbury jail.

Dalyk hugged and kissed his girlfriend, the mother of hisyoung daughter, in the courtroom, before being taken away.

He told the court he plans to get an education, a job and live a drug-free life, after he is released from jail 2.5years from now.
