Sudbury police misconduct allegation goes to hearing today

A Sudbury man will find out today if charges will be laid against a Sudbury police constable.

Tanner Currie alleges Constable Christopher Labreche used excessive force against him last spring.

Currie said he hopes the court will determine he has enough evidence to move forward with his case.

Its pretty clear cut to me, he said.We have the video. We have clear evidence.

Currie will give the court two video tapes from Sudbury police headquarters that show Constable Christopher Labreche throwing him face first into a window, smashing the glass.

If there was ever a case for police brutality, this is it, Currie said.

However, Sudbury Police dont agree, as they cleared Labreche of any wrong doing in an internal investigation last year.

Nobody is above the law

Now, its up to Curries lawyer to see if he can convince the courts to proceed with the case.

Trent Falldien said the credibility of the justice system is at stake.

Were hoping that after the end of this hearing, were able to say the justice system in Canada works and its true nobody is above the law, he said.

Currie said hes looking forward to the outcome of the hearing.

If the justice of the peace thinks that this case isnt actually courtroom worthy, I mean, I just sit down with Trent [Falldien]. Well just talk it out, he said.

And me and him will go from there, but I assume that we will be further pursuing this.

Sudbury Police wont comment on the case because its before the courts.

Falldien said hes prepared to appeal, if todays hearing doesnt go his way.
