Ontario court upholds pit bull ban

Ontario's pit-bull ban has been upheld by the province's highest court.

Ontario's pit bull ban has been upheld by the province's highest court.

The Ontario Court of Appeal ruledFriday that the ban on the breed does not violate any constitutional rights.

The law also survived a constitutional challenge last March, although some changes were ordered.

Superior Court Justice Thea Herman said a ban on "pit bull terriers" was unconstitutionally vague because it didn't refer to a specific type or breed of dog.

Lawyer Clayton Ruby, who challenged the law, called it a "sad day" in Ontario.

In a release, Ruby said Friday's decision means all of the amendments to the Dog Owners Liability Act are "in force" in Ontario, even the ones struck down by Herman as unconstitutional.
