ODonnell went on to note that any evidentiary hearings in the Jan. 6 case would be exactly like a prosecution and could embarrass Trump in the weeks leading up to the November election.

The New York Times notes it may be too late for the judge to revisit the conviction anyways as a deadline to file post-trial motions has already passed. The publication added the judge may instruct the former presidents attorneys to raise their concerns during an eventual appeal.

Never in the history of our Republic has a President had reason to believe that he would be immune from criminal prosecution if he used the trappings of his office to violate the criminal law, she wrote.

Moving forward, however, all former Presidents will be cloaked in such immunity. If the occupant of that office misuses official power for personal gain, the criminal law that the rest of us must abide will not provide a backstop.

Under our constitutional structure of separated powers, the nature of Presidential power entitles a former President to absolute immunity from criminal prosecution for actions within his conclusive and preclusive constitutional authority. And he is entitled to at least presumptive immunity from prosecution for all his official acts, Roberts wrote.

There is no immunity for unofficial acts, Roberts added.

Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett joined Roberts in the majority.

Justice Sonia Sotomayor penned the dissent, joined by Justices Elena Kagan and Ketanji Brown Jackson.
